Landlord applied for MCI rent hikes based on the installation of a new boiler/burner. The DRA ruled against landlord because landlord didn't submit a government sign-off for the work. Landlord appealed, arguing that the DHCR routinely accepts sign-offs at the PAR level. In addition, the DRA didn't request the gas boiler sign-off from landlord. Landlord submitted a copy of the required DOB approval with its PAR. The DHCR ruled for landlord.
