Rent Increase Based on Comparable Rents

Yonkers landlord filed a 60-day notice of maximum rent adjustment, seeking a 9.5 percent increase of rent-controlled tenant's rent. The DRA granted a rent increase to $983 instead of $1,071. Landlord appealed and lost. Rent increases for rent-controlled tenants can't exceed the average legal regulated rent for comparable apartments subject to the ETPA.
