Rent Hikes for New Garages Improperly Based on Room Count

Landlord applied for MCI rent hikes based on the installation of new garage doors. The DRA ruled for landlord. Tenant appealed, claiming that the MCI increase was incorrectly based on room count rather than on the number of garages and tenants who leased garage spaces. Also, some garage leases covered more than one garage space. The DHCR ruled for tenant. Landlord replaced 30 garage doors. But not all the garages were occupied by tenants, and some tenants didn't lease garages.
