Rent Hike Granted for Stoop and Walkway Replacement

The DRA granted landlord's application for MCI rent hikes based on the replacement of a stoop and concrete walkway, but denied any rent increase for a metal door and railing along with additional walkway repair. Tenants appealed, claiming that the walkway and stoop installation was mere maintenance and repair work and didn't qualify as an MCI. The DHCR ruled against tenants. The old walkway and stoop were cracked and sunken. Landlord totally demolished them and replaced them with new concrete. All walkway areas around the building were replaced. The work qualified as an MCI.
