Rent Guidelines Board Order No. 37 Upheld

RSA, a landlords' organization, sought court review of one- and two-year renewal lease rent increases set for rent-stabilized tenants by Rent Guidelines Board Order No. 37, for the period between Oct. 1, 2005, and Sept. 30, 2006. RSA claimed that the Board's explanation for the rent increase levels it set weren't rational. The court and appeals court ruled against RSA. The Rent Stabilization Law didn't require the Rent Guidelines Board to state reasons for the rent increase levels it chose.

In addition, the Board's Explanatory Statement, together with the entire record of proceedings held before the rent guideline increases were set, provided sufficient detail to find that the Board's decision had a rational basis.
