Rent Frozen Due to Missing Rent Registration

Rent-stabilized tenant complained of a rent overcharge. The DRA found no overcharge, but froze tenant's rent at the level in effect on the base date four years before tenant's complaint was filed based on landlord's failure to file annual registration statements for 2007, 2008, 2009, and 2010. Landlord appealed, claiming that the late registrations were filed while the case was pending before the DRA, so the rent should have been restored. The DHCR ruled against landlord. Although landlord filed registration statements for 2008, 2009, and 2010, it still hadn't filed one for 2007.
