Rent Frozen Based on Failure to Register

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. The DHCR ruled against landlord. Tenant moved into the apartment in September 1990 at a monthly rent of $1,200. Landlord didn't register tenant's apartment in 1990. Therefore tenant's rent was frozen between Sept. 1, 1990, and Aug. 22, 1994, when landlord filed a late registration. It didn't matter that the apartment had been registered in prior and subsequent years.
