Landlord applied for MCI rent increases based on new windows. The DRA denied landlord's application because a building-wide service reduction order was in effect. Landlord appealed, pointing out that the rent reduction order wasn't in effect at the time the MCI application was filed. The DHCR found that this didn't matter. On the date the application was decided, landlord wasn't providing required services to the building. Landlord's PAR was dismissed.
