The DRA ruled for tenant and revoked landlord's eligibility to collect fuel cost adjustments for tenant's apartment. This order was based on a rent-reduction order issued a month earlier based on landlord's failure to provide heat and hot water. Landlord appealed. The DHCR ruled against landlord. Rent control regulations provided that if a rent-reduction order is issued for not providing heat or hot water, a fuel cost adjustment can't be collected for the period that the rent-reduction order remains in effect.
