Rent-Controlled Tenants May Have to Pay Rent Increases for New Basement and Roof Doors

Landlord applied for an MCI rent increase for new roof and basement doors. Landlord claimed that rent-controlled tenants should pay an MCI rent increase for this work because Rent Control Advisory Sheet 1-33.1e permits an increase for cosmetic improvements done in connection with MCI work. The DRA denied landlord's application, and landlord appealed. The DHCR ruled that the work might qualify for a rent hike. Landlord had incurred the costs, based on the rules that were in effect at the time. The DHCR sent the case back to determine whether the new doors could qualify.
