Registrations Contained Incorrect Information

Rooming house tenant complained of a rent overcharge. He claimed that he never received a lease or RR-1 form when he moved into the apartment in 1986 and that his $325 monthly rent constituted an overcharge. The DRA ruled against tenant, finding that landlord had sent and filed rent registration forms on April 1, 1987, that tenant had never paid more than $325 and that there was no rent overcharge. Tenant appealed, still claiming that the rent registration for the apartment was improper. The DHCR ruled for tenant.

Tenant appealed, still claiming that the rent registration for the apartment was improper. The DHCR ruled for tenant. DHCR's records showed that landlord had improperly registered the apartment with incorrect tenant and rent amount information in 1986 and 1987. So the base date for determining any overcharge was April 1, 1984, and there was a $17,000 rent overcharge.
