Reduction in Building Staff Didn't Decrease Janitorial Service

Rent-controlled tenant complained of a reduction in building-wide services. Tenant claimed that landlord had reduced the number of janitorial staff at the building and that now one person acted as the porter. The DRA ruled against tenant, who appealed and lost. The DHCR's inspector found that janitorial services were being adequately maintained building-wide, including on the sidewalks, in the courtyards, in the basement, and in the trash storage area. Rent control regulations also provide that a decrease in the number of superintendent or maintenance staff or the failure to provide an on-site super is a minor condition.
