Recyclable Paper Mixed with Other Trash

DOS issued a violation notice to landlord for placing out recyclable paper and other garbage in the same bag for trash collection. Landlord objected, but the ALJ fined him $25. Landlord appealed and lost. Landlord claimed that the only paper placed in the bag with the regular trash was discarded mail, soiled napkins, and paper plates. But recycling rules designate recyclable materials to include junk mail and envelopes, including plastic window envelopes. So, by landlord's own admission, he had mixed recyclable material in with other garbage.
