Records Prove Tenants Were Rent Controlled

Landlord asked the DHCR to determine tenants' status. The DRA ruled that tenants were rent controlled. Landlord appealed and lost. Evidence supported a finding that tenants were rent controlled. The building was constructed prior to 1947 and had four apartments. Tenants, a husband and wife in their eighties, had lived in her apartment for 50 years. Tenant husband signed an initial lease commencing May 1, 1963. Rent-control records were filed for the apartment with the DHCR's predecessor agencies in 1943 and 1963. MBR records also were on file for 1984-85.
