Receptacles Put Out on Non-Collection Day

DOS issued a violation notice to landlord for not storing trash receptacles. Landlord had left two large trash bags at curbside for collection on a non-pickup day. Landlord claimed that tenants put garbage out on an earlier night because an unidentified uniformed person told them that the pickup day had been changed. The ALJ ruled against landlord and fined her $50. Landlord appealed, claiming that the trash was put out on the correct night. ECB ruled against landlord. Landlord didn't prove that the trash was put out on the right evening.
