Radiators Inoperative

Tenant complained of inadequate heat. The DRA ruled for tenant after an inspection and reduced his rent. Among other things, the DRA found that the radiators in tenant's living room and bedroom were inoperative. Landlord appealed, claiming that the radiators had been disconnected to make floor repairs. The DHCR ruled against landlord. Landlord never raised this claim before the DRA and couldn't do so on appeal.
