Protruding Keystone

DOB issued a violation notice to landlord for not maintaining the building's facade. Landlord denied that a keystone was protruding from the third-floor facade and was in danger of falling. The ALJ ruled against landlord and fined him $800. Landlord appealed, pointing out that the police had refused DOB's request to barricade the area in front of the building, even though DOB claimed it was an emergency situation. ECB ruled against landlord. The police decision in and of itself didn't contradict DOB's finding.
