Prior Tenant in Occupancy for at Least 10 Years

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord showed that the DRA made a calculation error. Prior tenant had been in occupancy for at least 10 years. So landlord was entitled to a longevity bonus for 10 years in calculating the legal rent. The DRA had calculated the bonus based on only nine years. The DHCR ruled for landlord based on the DRA's error.
