Prior Tenant Lived in Apartment for Eight Years

LVT Number: 18453

Tenant complained of a rent overcharge. The DRA ruled for tenant. Landlord appealed, claiming that the DRA incorrectly disallowed a longevity rent increase. Landlord had submitted rent ledgers showing that prior tenant lived in the apartment for eight years. The DHCR ruled for landlord. Based on its proof, landlord was entitled to a longevity increase of 0.6 percent of the prior, base rent multiplied by eight. This reduced the total amount of the rent overcharge.
