Prior Service Reduction Complaints Denied

Rent-controlled tenant complained of a rent overcharge. The DRA ruled for tenant. Landlord appealed. Tenant had filed two complaints based on reductions in services in 1985. But the DHCR had dismissed those complaints. Landlord argued that the DRA incorrectly froze tenant's rent based on the two service complaints. The DHCR ruled for landlord. Because the complaints had been dismissed, there was no reason to freeze tenant's rent. Landlord was entitled to collect the last MCR increase, effective Jan. 1, 2007.
