Prior Landlord Not Liable for Lead Poisoning

Tenant sued landlord, claiming that her child had suffered lead poisoning as a result of high lead levels in the paint in their apartment. Tenant had lived in the apartment with her child from May 1993 until July 1998. Landlord bought the building in October 1993. Landlord claimed that prior landlord should be joined in the lawsuit. The court ruled against landlord. There was no proof that the child had an elevated lead level in her blood while prior landlord owned the building.
