Prior DHCR Approval Not Needed to File Late Apartment Registrations

In 2022, landlord submitted annual apartment registration forms for one apartment to the DHCR, noting that the apartment hadn't previously been registered for the years 2009 to 2016, and that a separate DHCR order had directed amendment of registrations for the years 2006 to 2008 and 2017 to 2020. The DRA dismissed landlord's application, and advised landlord to contact the DHCR's Rent Registration Unit. The DRA pointed out that, for late registrations, an order to amend apartment registrations wasn't required by the DHCR.

The DRA pointed out that, for late registrations, an order to amend apartment registrations wasn't required by the DHCR. Landlord appealed, and the DHCR dismissed the PAR proceeding. While the prior DHCR order had directed landlord to register the apartment for certain years, landlord was now requesting to file late annual registrations for the years 2009-2016 and to amend previously submitted annual registrations for the years 2006-2008 and 2017-2020. Landlord should contact the Rent Registration Unit to properly register the apartment for all the years in question.
