Pointing/Masonry Work Qualified as MCI

Landlord applied for MCI rent hikes based on pointing and masonry work. The DRA ruled for landlord in part but disallowed any increase for scraping, priming, and painting of lintels that were not replaced. Landlord and tenant both appealed and lost. The DRA properly granted the MCI increase for pointing/masonry that was performed as part of a unified plan and consecutively timed project completed within a reasonable time frame. The useful life of the prior point work was 25 years and had expired.
