Pointing Work Qualifies as MCI

The DRA denied landlord's application for MCI rent hikes, finding that pointing and roof replacement hadn't been completed as necessary to qualify as an MCI. Landlord appealed and won. The DRA's inspector found that no pointing work was done on one side of the building. But an HPD inspection report stated that pointing work had been observed on all sides of the building. The DHCR reconsidered and found that pointing had been completed on all exposed sides of the building. This qualified as an MCI.
