Peeling Plaster Was Minor Condition

Tenants complained of a reduction in building-wide services, based on conditions that included peeling paint and plaster. The DRA dismissed the complaint, finding no reduction in services. Tenants appealed and lost. Among other things, they claimed that peeling paint and plaster warranted a rent reduction. But this condition had only a minimal impact on tenants, wasn't a health hazard, and didn't affect their use and enjoyment of the premises. The DHCR's inspector found this condition to be de minimis, or minor, so no rent reduction was warranted.
