Partial Structural Steel Work Didn't Qualify as MCI

Landlord applied for MCI rent hikes based on structural steel column replacement and intercom installation. The DRA ruled against landlord, who appealed and lost. To qualify as an MCI, structural steel work must include complete new replacement of all beams, including footings and foundation. Landlord’s steel work wasn’t a complete new replacement. The fifth-floor-level existing column was replaced with new steel some time ago during a previous repair to that corner of the building.

And landlord and its contractor both stated in the application that only two of the four corner columns of the building were replaced.
