Painting Not Required Service

Tenant complained of a reduction in services, claiming his apartment hadn't been painted since 1978. The DRA ruled against tenant, and tenant appealed. The DHCR again ruled against tenant. Painting by landlord was only required if landlord had provided this service in 1979 when the Village of Freeport adopted the ETPA. There was no showing that landlord had done so, so painting wasn't a required service.
