Oven Venting System Was Normal

Tenant complained of a reduction in services based on a defective oven. The oven gave off heat that made the kitchen cabinets warm to the touch. Tenant thought this was dangerous. The DRA ruled for tenant and reduced his rent. Landlord later applied for rent restoration based on restoration of services. The DRA ruled against landlord. Landlord appealed. Landlord had submitted a statement from the oven manufacturer saying that the heat came from the oven's vents. This type of vent was part of all wall ovens.

The manufacturer gave landlord a certificate of compliance and said nothing was wrong with the oven. The heat vented onto the oven handles and this made the cabinets warm. The DHCR ruled for landlord. An inspection showed no design defect and there was no indication that the oven was dangerous or unusable.
