Occupant Treated as Tenant

Landlord sued to evict occupant, claiming that she was a licensee. Occupant claimed that she was treated as a tenant. The court agreed and ruled for occupant. Occupant had lived in the apartment since 1989. The prior landlord accepted rent from her. And, beginning in 1989, several eviction proceedings had been brought to evict occupant for nonpayment of rent. The nonpayment petitions all claimed that there was a landlord-tenant relationship.
