Occupant Lived in Hotel Room for Six Months

LVT Number: 12950

Landlord sued to evict illegal hotel occupant. Occupant claimed that she'd lived in the hotel room since 1989 and that she paid rent directly to landlord. She claimed she could remain in the apartment as a rent-stabilized tenant. The court ruled for occupant, finding that she was a rent-stabilized tenant in her own right under the Rent Stabilization Code since she'd lived in the hotel as her primary residence for more than six months.
