Landlord sued to evict tenant for nonpayment of rent. Landlord claimed that the apartment wasn't subject to rent stabilization. The trial court disagreed and dismissed landlord's petition. Landlord appealed. The appeals court again dismissed the case. The fact that landlord had reduced the number of apartments in the building to less than six didn't remove the building from rent stabilization coverage. Similar court rulings had already been made concerning other apartments in the building.
