Notice Against Loft Tenant Need Not Comply with Rent Stabilization Law

Landlord sued to evict loft tenant after sending tenant a 30-day termination notice. Tenant asked the court to dismiss the case. She said landlord's termination notice was defective because it didn't comply with the requirements of the Rent Stabilization Code. The court ruled against tenant. Landlord sent tenant the termination notice in February 2005. At that time, the building was subject to the Loft Law.

Landlord sent tenant the termination notice in February 2005. At that time, the building was subject to the Loft Law. The building didn't become subject to rent stabilization until May 2005. So at the time the termination notice was delivered, the notice didn't have to comply with any requirements of the Rent Stabilization Code.
