Nonrenewal Notice Not Specific Enough

LVT Number: 19011

Landlord sued to evict rent-stabilized tenant for nonprimary residence. Tenant asked the court to dismiss the case. He claimed that landlord's nonrenewal notice wasn't specific enough. The court ruled for tenant. Landlord appealed and lost. Landlord's notice stated only that tenant was ''living at another location,'' didn't state where that location was, and didn't set forth any specific facts as to why landlord had claimed nonprimary residence. Landlord's notice didn't satisfy the requirements of Rent Stabilization Code Section 2524.2(b).
