Nonpayment Petition Incorrectly Stated Regulatory Status

Landlord sued to evict tenant for nonpayment of rent. Landlord claimed that tenant's apartment was unregulated and exempt from rent-stabilization because the building had been substantially rehabilitated after Jan. 1, 1974. Tenant claimed that the building was rent-stabilized under the Loft Law and asked the court to dismiss the case. The court ruled for tenant. Tenant submitted a copy of a Loft Board Order that confirmed tenant's regulated status. Also, tenant claimed that the building hadn't been substantially rehabilitated, and landlord showed no proof to the contrary.
