(Decision submitted by Jill Axelrod of the Manhattan law firm of Rosenberg & Estis, P.C., attorneys for the landlord.) Tenant complained of a reduction in services. The DRA ruled for tenant and reduced his rent based on confirmation of tenant's complaint of water accumulation in the canopy over the building entrance. Landlord later applied to restore the rent. The DRA ruled for landlord, and tenant appealed. Although tenant admitted that a drain pipe was installed, preventing water accumulation on the canopy, he now claimed that water accumulated next to the entrance door under his window, causing offensive odors. The DHCR ruled against tenant. The condition complained of had been remedied, and the rent was properly restored.
