No Rent Reduction Where No HPD Hot Water Violation on Record

Rent-stabilized tenant complained of a reduction in services based on inadequate hot water. The DRA ruled against tenant, who appealed and lost. As of April 30, 2014, when the DRA investigated, HPD’s online database showed no active violation for inadequate hot water in tenant’s apartment. The DRA properly relied on HPD’s records. Tenant claimed that HPD issued a hot water violation in April 2014, but this evidence wasn’t before the DRA at the time the case was decided.
