No Rent Increase Permitted for Used Refrigerator

Rent-stabilized tenant complained of rent overcharge. Among other things, landlord pointed out that individual apartment improvements (IAIs) had been made to the apartment before tenant moved in. The DRA ruled for tenant, after disallowing the cost of some of the IAIs. Landlord appealed and lost. Landlord had installed kitchen appliances. But the DRA disallowed the claimed $1,025 cost for the refrigerator because DHCR inspection showed that the appliance wasn't new.
