No Proof Landlord Didn't Maintain Plumbing System

DOB issued a violation notice to landlord for not maintaining the plumbing system. The inspector found sewage leaking from a sewer pipe in the basement, causing a hazardous condition. Landlord claimed that he wasn't notified of the condition until three days after the violation was issued, at which time he promptly made repairs. The ALJ ruled against landlord, and landlord appealed. ECB ruled for landlord.

Landlord claimed that he wasn't notified of the condition until three days after the violation was issued, at which time he promptly made repairs. The ALJ ruled against landlord, and landlord appealed. ECB ruled for landlord. Landlord's plumbing repair order stated that the pipe was temporarily clogged with paper products and merely needed to be cleaned out, which landlord did soon after being notified of the condition. This condition by itself didn't constitute a failure to maintain the plumbing system.
