No Proof Floor in Danger of Collapsing

Rent-stabilized tenant complained of a reduction in services, claiming that the apartment’s living room floor wasn’t maintained. The DRA ruled for tenant and reduced his rent. Inspection showed that the floor was rusted, cracked, splintered, and water damaged. Landlord appealed and won, in part.

Rent-stabilized tenant complained of a reduction in services, claiming that the apartment’s living room floor wasn’t maintained. The DRA ruled for tenant and reduced his rent. Inspection showed that the floor was rusted, cracked, splintered, and water damaged. Landlord appealed and won, in part. The DRA’s order stated that the living room wooden floor squeaked and presented a potential for collapsing with heavy weight. But the DHCR’s inspector noted that there was no evidence of a collapsed or collapsing living room floor. Landlord pointed out that DOB inspection in 2014 also didn’t find that the floor would collapse. The DRA’s order should be amended to note that there was no indication that the floor would collapse.
