No Proof of Authorization for Tenant Representative

The DRA granted landlord's MCI rent hike application based on the installation of a TV/security system. Someone who wasn't a building tenant appealed, claiming that she was the tenant representative and was authorized to file the PAR on behalf of the tenants' association. The DHCR dismissed the PAR because there was no proper authorization sheet containing the names, addresses, and signatures of all tenants joining in the PAR.

The DRA granted landlord's MCI rent hike application based on the installation of a TV/security system. Someone who wasn't a building tenant appealed, claiming that she was the tenant representative and was authorized to file the PAR on behalf of the tenants' association. The DHCR dismissed the PAR because there was no proper authorization sheet containing the names, addresses, and signatures of all tenants joining in the PAR. The person filing also failed to include any written resolution by a tenant organization authorizing the representative to file on their behalf along with a current membership roll for the association. Alternatively, an officer of the organization should have submitted a signed authorization with the PAR. Even if proof of a representative's authority was submitted to the DRA, it must be resubmitted with the PAR.
