No Permit Required to Install Storage Units

DOB issued violation notices to landlord co-op corporation for installing 18 commercial storage units in the cellar without a work permit, and for changing the use of the laundry room in violation of the building's Certificate of Occupancy (C of O). Landlord claimed that no permit was needed and that the C of O said nothing about the use of the cellar. The ALJ ruled against landlord and fined it $2,000. Landlord appealed and won.

Landlord claimed that no permit was needed and that the C of O said nothing about the use of the cellar. The ALJ ruled against landlord and fined it $2,000. Landlord appealed and won. A work permit wasn't needed for minor alterations that didn't affect health, fire, or structural safety, and there was no proof to the contrary concerning the storage units. And since the C of O didn't designate a use for the cellar, the storage units didn't violate it.
