DOB issued a violation notice to landlord for doing plumbing work in a basement apartment without a permit. Landlord claimed that no permit was required since landlord was repairing a leak by soldering pipes. The ALJ ruled for landlord, and DOB appealed, claiming that landlord's work did require a permit because the bathroom wall was cut away and water distribution pipes were removed. ECB ruled for DOB and imposed a $350 fine. DOB showed alterations were done to the piping and water distribution, which would require a permit.
