No Penalty for Landlord Who Corrected Wall Crack

DOB issued a violation notice to landlord for failing to maintain an exterior building facade. DOB’s inspector stated that there were several cracks at various locations of the building walls. At a hearing, landlord presented a Certificate of Correction dated Feb. 9, 2016. The cure date provided in the violation was Feb. 22. The ALJ ruled against landlord and imposed a reduced fine of $1,000. Landlord appealed and won. Landlord claimed that, since it cured the violating condition before the cure date listed in the violation notice, no penalty should be imposed.
