LVT Number: 14304

(Decision submitted by Alan Kucker and Santo Golino of the Manhattan law firm of Kucker & Bruh, LLP, attorneys for the landlord). Loft tenant's roommate sued landlord after tenant died. The roommate claimed pass-on rights. She said that she was a nontraditional family member of tenant's. Landlord claimed that the roommate had no pass-on rights because the loft law didn't provide for any. Landlord asked the court to dismiss the case and permit eviction. The court ruled for landlord. There is no right to pass on apartments under the loft law.
