No Notice to DOB of Elevator Accident

DOB issued a violation notice to landlord for not reporting an elevator accident. Landlord claimed it was never notified of the accident. The ALJ ruled against landlord and fined it $460. Landlord appealed. ECB again ruled against landlord. DOB submitted to the ALJ a copy of a letter from the accident victim's husband to landlord on Sept. 2, 1993, notifying landlord of the accident, which took place on Aug. 18. The violation notice was issued on Dec. 29, 1993.

DOB submitted to the ALJ a copy of a letter from the accident victim's husband to landlord on Sept. 2, 1993, notifying landlord of the accident, which took place on Aug. 18. The violation notice was issued on Dec. 29, 1993. The letter pointed out that complaints had been made that the elevators didn't level, causing them to open either above or below floor level. Even if landlord never received the letter, such an accident would certainly have come to landlord's attention.
