No Need for Electric Lights During Daylight Hours

Tenant complained of a reduction in services because hallway lights weren't on during daylight hours. An inspection confirmed tenant's claim, and the DRA ruled for tenant. Landlord appealed, claiming that there was sufficient natural light in the hallways during daylight hours, that the law didn't require lights on during the day, and that in 50 years, landlord never got a building violation for this condition. The DHCR ruled for landlord. The DHCR's own inspector had noted that there were large windows allowing outside light into the building's hallways.

And Housing Maintenance Code Section 27-2039 states that lights have to be kept on during daylight hours only if there is insufficient natural light inside the building.
