No Mold Found by DHCR Inspector

Rent-stabilized tenant complained of a reduction in services. He claimed that bedroom closets had water leaks, mold, peeling paint and plaster, and a "mushy" odor. The DRA ruled against tenant, finding no service reduction. Tenant appealed and lost. Tenant claimed that landlord's repair efforts were ineffective and submitted an inspection report from an environmental service company indicating there were high moisture levels in the apartment and that mold spores were present.

Rent-stabilized tenant complained of a reduction in services. He claimed that bedroom closets had water leaks, mold, peeling paint and plaster, and a "mushy" odor. The DRA ruled against tenant, finding no service reduction. Tenant appealed and lost. Tenant claimed that landlord's repair efforts were ineffective and submitted an inspection report from an environmental service company indicating there were high moisture levels in the apartment and that mold spores were present. Landlord, on the other hand, had submitted a copy of its contractor's invoice for painting and plastering the closets and waterproofing the roof above tenant's apartment. The DHCR's inspector found no defects or evidence of any dark substance on the walls or ceiling, and no odor in the closets. And although there were HPD violations on the apartment in 2008 for peeling paint and plaster, the apartment and the entire building were currently violation free.
