No MCI Rent Hike for Rent-Stabilized Tenant

Landlord applied for an MCI rent hike for the building's sole rent-stabilized tenant based on installation of a boiler, burner, windows, parapet/exterior walls, intercom/mailboxes, entrance lobby vestibule doors, chimney/cornice, and fire escape/steps. The DRA ruled against landlord, who appealed and lost. In a separate proceeding, the DHCR ruled that the building was exempt from rent stabilization due to substantial rehabilitation of the building after Jan. 1, 1974. One tenant, who lived in the building since before it was rehabbed remained rent stabilized.
