No MCI Rent Hike Due to Building-Wide Rent Reduction Order

Landlord applied for MCI rent hikes based on an elevator upgrade. The DRA ruled against landlord based on an outstanding building-wide rent reduction order. Landlord appealed and lost. The rent reduction order was in effect when the DRA’s MCI order was issued. Although the DHCR later ruled that only 14 tenants were subject to the rent reduction, it didn’t matter because the rent reduction was in full force and effect when the MCI application was decided.
