No MCI Increase for Architect Fees

Landlord applied for MCI rent hikes based on the installation of a cooling tower, main roof replacement, and the replacement of 10 terrace roofs. The DRA ruled for landlord but denied any MCI increase for related architect consulting fees. Landlord appealed and lost. Landlord claimed that the architect provided supervisory services. But it's long-standing DHCR policy that architect fees can be included in approved MCI costs only if they are necessary and customary for the work done.

The replacement of a rooftop surface is relatively commonplace and didn't require an architect in addition to the contractor.
